Tote Us Schnellboot respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Tote Us Schnellboot service and/or website (the “Site”) if such claims are reported to our Designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Filing a DMCA Notice of Alleged Infringement

To file a DMCA notice, you must provide a written communication that sets forth the items specified below. You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is infringing your copyrights. Accordingly, if you are not sure whether certain material infringes your copyright, we suggest that you first contact an attorney.

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of infringing material: A description of where the material that you claim is infringing is located on our Site, with enough detail that we may find it. Providing URLs in the body of an email is the best way to help us locate content quickly.
  3. Your contact information: Your address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Statement under penalty of perjury: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Electronic or physical signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

DMCA Counter-Notification

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written communication that sets forth the items specified below. You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • Statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Consent to jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Tote Us Schnellboot may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or physical signature: An electronic or physical signature of the subscriber.
